GEMA at the regional court: The injunction against Youtube can not be granted

The GEMA failed at the Landgericht Munich with the injunction, which should prohibit Youtube, to display the famous and hated barred users. The lawsuit could not be granted. The next step is the international legal process. However, before Youtube resp. Google respond and make changes, could several weeks in the country cancel. This was announced by GEMA spokeswoman Ursula Goebel against the news agency dpa.


As we reported, GEMA had filed a complaint in the past days because of false information in the blocking board on the Youtube video portal of Google. The data displayed would not be true. In the case of videos that are not shared, Youtube means that they "may contain music for which the necessary music rights have not been granted by the GEMA." The wording is not correct, since the GEMA itself did not have caused the blocking of corresponding videos. Specifically, in 12 cases, video material was blocked after the GEMA made appropriate applications.


These are music videos, which were the subject of a court case between Google and MTV marketer Viacom. The case was closed in mid-2012. Google and / or Youtube responded with a rigorous sorting of videos with supposedly protected music. The result: As OpenDataCity noted, 61.5 percent of the 1,000 worldwide most popular videos are blocked on Youtube in the United States. According to the Viacom case, GEMA retained the right to apply for locks when using toll-paying music.


The current development, however, is based on a more arbitrary blocking practice on the part of Youtube operators. Through the blocking board the picture emerges that the GEMA is actively responsible for the blocking of popular videos. But this is not the case. It remains to be seen whether and when GEMA will be successful with the injunction against Youtube. We will of course keep you up to date.
